US Seeks Stay of Ruling on Obama Immigration Action

HOUSTON — The U.S. government asked a federal judge Monday to lift his temporary hold on President Barack Obama’s action to shield millions of immigrants in the country illegally from deportation.

The Department of Justice filed an emergency stay with the district court, stating that the injunction was issued in error and that DHS is likely to prevail on the merits. As the stay also points out,

[t]hat the Court’s reasoning on standing and the merits has been rejected by other district courts further underscores the fact that Defendants have a substantial case on appeal.
